This is the agreement between you and Hurley's Earthworx, which operates DirtIQ. Using DirtIQ means you accept it. It's written to be read.
The short version.Your data is yours. We won't sell it or bid against you. DirtIQ is a tool for building an estimate — every number that goes out under your name is yours to check, including anything the assistant suggests. It's beta software, so expect rough edges.
Your data belongs to you
Your costs, rates, bids, projects and files remain yours. You give us permission to store and process them only so far as running DirtIQ requires — showing them back to you, calculating with them, and sending them to the services listed in our privacy page when you use a feature that needs one. Nothing more.
We may look at how DirtIQ is used in aggregate — which features get used, where people get stuck — to make it better. That never includes sharing your costs, prices or customers with anyone.
Estimates are yours to check
DirtIQ helps you build an estimate. It does not decide what a job should cost, and it cannot know what your job will actually take. Before anything goes to a customer, it is your job to check it. In particular:
- Starter sample pricesare illustrative round numbers, not market data and not anyone's real costs. They are tagged as samples in the app, and bids that rely on them show a warning. Replace them with your own numbers.
- Dirt Assistant suggests; you approve. It can be wrong, and it is told to price only from your own library and to flag anything it cannot find.
- Takeoff measurements depend on the scale you set and the lines you draw. Check them against the plans.
We are not responsible for a bid that came in low, a job that lost money, or work won or lost using DirtIQ.
Your account
Keep your password to yourself; you are responsible for what happens under your account and for the people you invite into your workspace. Tell us promptly at andrew@hurleysearthworx.comif you think someone has got in who shouldn't have.
Fair use
Don't use DirtIQ to break the law, to upload other people's confidential documents without the right to, to attack or overload the service, or to copy it as a competing product.
Beta
DirtIQ is in beta and free while it is. Features will change and break. There is no uptime guarantee, and support is us answering email as fast as we can. If we start charging, you will get notice first and a chance to decide before any bill.
Ending it
Stop whenever you like. Ask us for a copy of your data before or after, and we'll send it. We can close an account that breaks these terms or that puts the service or other customers at risk, and except in serious cases we'll warn you first and give you a chance to export.
Warranty and liability
DirtIQ is provided as-is, without warranties of any kind. To the extent the law allows, Hurley's Earthworx is not liable for lost profits, lost work, lost bids, or indirect or consequential damages. Our total liability for any claim relating to DirtIQ is limited to what you paid us in the twelve months before it arose — which, during the free beta, is nothing.
Some states don't allow certain limitations, so parts of this section may not apply to you.
Changes
We may update these terms. If a change materially affects you, we'll tell account owners by email rather than quietly editing this page. Continuing to use DirtIQ after a change means accepting it.
Law
These terms are governed by the laws of North Carolina, and any dispute belongs in the courts there.
